Welcome to PerfectListing.ai, operated by The Tech Reviewer Inc., a Delaware S-Corp (“Company,” “we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your access to and use of our website, app, and related services (collectively, the “Service”).

By accessing or using PerfectListing.ai, you agree to these Terms and our Privacy Policy. If you do not agree, please do not use the Service.

1. Eligibility

You must be at least 18 years old and legally able to form a binding contract to use the Service.

2. Accounts

• You must create an account to access certain features.
• You are responsible for maintaining the confidentiality of your credentials and all activity under your account.
• You agree to provide accurate and current information and keep it up to date.

3. Use of the Service

You agree to use the Service only for lawful purposes. You may not:

• Copy, distribute, or disclose any part of the Service without authorization.
• Attempt to reverse engineer or extract source code.
• Use automated systems (bots, scrapers, crawlers) to access the Service without permission.
• Upload or share content that is unlawful, harmful, or infringes others’ rights.

4. Subscriptions and Payments

• Certain features require a paid subscription. By subscribing, you authorize us (via Stripe) to charge your selected payment method.
• Subscriptions renew automatically unless canceled before the next billing date.
• All payments are non-refundable except as required by law.
• Pricing and plan details may change with notice; continued use after notice constitutes acceptance of the updated pricing.

5. Lifetime, Early-Access, or Launch Pricing

Discounted or “lifetime” pricing plans are valid only while the user’s subscription remains active and in good standing. Canceling or allowing a lapse in billing immediately voids lifetime or launch-pricing status. If you later return to the Service, you will be charged at the then-current standard rate. We reserve the right to verify plan status and enforce these terms to ensure fairness.

6. Credits and Add-Ons

• Certain features (like AI image generation or listing exports) operate using credits.
• Credits and add-ons are non-refundable and non-transferable, regardless of whether they are used.
• Credits may expire based on your plan terms and are not reinstated after cancellation.

7. Generated Content

PerfectListing.ai uses AI models to create property descriptions and marketing content (“Generated Content”). You are solely responsible for verifying and editing Generated Content before publishing. We do not guarantee its accuracy or compliance with MLS, Fair Housing, or local advertising standards.

8. AI Providers

We integrate with third-party AI providers, including (but not limited to) OpenAI, Anthropic/DeepSeek, Perplexity, and Google Gemini. Your use of the Service is also subject to those providers’ acceptable-use and data policies.

9. Data and Privacy

We collect and process personal data as described in our Privacy Policy. By using PerfectListing.ai, you consent to that processing.

10. Image Uploads

You may upload property photos for processing. Images are stored securely for 90 days and should not include identifiable individuals or private data.

11. Beta Disclaimer

PerfectListing.ai is currently in early access. Features and pricing may change without notice. You acknowledge that the Service may contain bugs or limitations and use it at your own risk.

12. Termination

We may suspend or terminate your account at any time for violations of these Terms. Sections concerning intellectual property, disclaimers, and limitations of liability will survive termination.

13. Disclaimers

The Service is provided “as is” and “as available.” We make no warranties, express or implied, regarding reliability, suitability, or accuracy. We do not guarantee uninterrupted or error-free operation.

14. Limitation of Liability

To the fullest extent permitted by law, The Tech Reviewer Inc. and its affiliates are not liable for indirect, incidental, or consequential damages arising from your use of the Service. Total liability will not exceed the amount paid in the three months preceding the claim.

15. Indemnification

You agree to indemnify and hold harmless The Tech Reviewer Inc., its employees, and affiliates from any claims, damages, or expenses arising out of your use of the Service or your Generated Content.

16. Governing Law

These Terms are governed by the laws of the State of Delaware, United States. Any disputes will be resolved exclusively in the courts of Delaware.
